Evidence:
Following the running of Race 2, the SVS STARTING GATES MAIDEN HURDLE, Mr Jones presented an Information charging Ms T Moki with breaching Rule 330(3)(c) in that:
(a)Â she failed to make the handicapped weight for her mount, “SHOCKING BILL” in Race 2, and
(b)Â she failed to make the handicapped wieght for her mount in Race 5 “MEANT TO BE” (for which ride she had to be replaced).
Ms Moki was 2kg over the weight she was required to make.
Ms Moki admitted the charges, which are contained in one Information. She advised that she had done her best and felt she needed help to manage her weight.
Decision:
As the breaches were admitted, they were deemed proved.
Submissions for Penalty:
Mr Jones advised that MsMoki had a poor record of breaching this Rule on 3 occasions in the past 12 months, the most recent being on 25 May 2022 for which she was suspended for 3 days and fined $300. He contended that an uplift was required for these aggravating factors.
Ms Moki submitted that despite trying hard, she found it impossible to meet the weight required.
Reasons for Penalty:
Given the previous history of Ms Moki, and that she had let down the connections of 2 horses, a fine of $400 and suspension of her licence for 5 days commencing at the end of racing today, 18 June 2022 and concluding at the end of racing on 30 July 2022, were imposed.
Conclusion:
Ms Moki is fined $400 and suspended for 5 days.
