FACTS

Jockey S Fannin, Rider of HAPPY STAR in Race 1 and LUCKY VIKING in Race 2, admitted both charges that he struck both his mounts outside the allowable number prior to the 100 metre mark. They being seven times in Race 1 and six times in Race 2.

Mr Fannin agreed for both charges to be heard as one and confirmed the number of strikes after viewing the film.

DECISION

As the charges were admitted, they were deemed proved.

SUBMISSIONS ON PENALTY

Stipendiary Steward Mr Goodwin, asked for a period of suspension as per the Guidelines for Class D Riders. He also asked that a monetary penalty be imposed as Mr Fannin’s mount in Race 1 went on to win.

Mr Fannin had nothing to add.

REASON FOR PENALTY

The Adjudicative Committee pointed out to Mr Fannin that with the jumping and high weight season just beginning, he has already had two breaches of this Rule. He received a warning at Matamata and then at Wanganui on Thursday April 6, was fined.

As a Senior Class D Jockey, it was important for all concerned that he takes immediate steps to overcome his whip problem.

CONCLUSION

Mr Fannin was suspended from race riding until after the completion of racing on April 20, a period of two high weight days. Those being April19 at Matamata and April 20 at Otaki. A fine of $200 was also imposed.
