Evidence

Following the running of Race 5, the Respondent Mr S Fannin, admitted a charge alleging he struck his mount JESKO 13 times prior to the 100 metres.

Rule 638(3)(h)(i) provides that in a Jumps Race a Rider must not:

(i) strike a horse with a whip more than 10 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);

Using the available race films, Mr Jones demonstrated that the Respondent struck his mount 13 times prior to the 100-metre mark.  He showed on the film that after jumping the fence at the 1200m,  Mr Fannin applied 2 strikes, then another 2 at the 600m, with 9 further strikes in the straight, prior to the 100m.

Mr Fannin agreed with the Steward’s count.

Decision

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty

Mr Jones produced the Respondent’s record, which indicated a clear record under this Rule in the last 6 months.

Mr Jones said the starting point for a breach of this nature was a fine of $500. However, as the breach had occurred in a Prestige Jumping Race, a fine equal to 50% of the Rider’s winning stake, should apply in this case as provided for in the Penalty Guide. Mr Fannin’s mount JESKO won the race by 4.75 lengths. The total winning stake was $115,000.

Mr Jones said that Mr Fannin’s stake earnings for the race were $11,500 (50% of his share being $5,750).

The Respondent had nothing to offer in relation to penalty submissions.

Reasons for Penalty

In a Prestige Jumping Race, the penalty starting point is 50% of a Rider’s winning stake.

After considering the circumstances of the breach, the Adjudicative Committee has determined that there is no reason to deviate from the Penalty Guide. Mr Fannin’s share of the winning stake is $11,500, therefore a fine of 50% of this amount, $5,750 is applied.

Conclusion

Mr Fannin is fined $5,750.
