EVIDENCE:

Following the running of Race 8, Stipendiary Steward, Mr Vinnie Munro presented an Information alleging a breach of Rule 869(2) by Open Driver, Kirstin Green.

Ms Green stated she was conversant with the Rule and the Charge and confirmed she admitted the breach.

Mr Munro played the final straight video to identify Ms Green (HE’S A MEISTER) racing in the lead at approximately the 150m. Mr Munro pointed to Ms Green strike her horse 4 times well outside of the acceptable guidelines before returning to a complaint style.

Ms Green made no comment.

DECISION:

The Respondent having admitted the breach the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Munro said Ms Green is a very busy Driver and had been warned over her whip use. Mr Munro said this breach is low level and a fine of $300 was in order.

Ms Green made no submissions.

REASONS FOR PENALTY:

The Penalty Guidelines provide a $300 fine or a 2-day suspension for a low-level breach, as in this case.

The Adjudicative Committee sees no factors to depart from the Guidelines in the circumstances of this case and consider a $300 fine as the appropriate penalty.

CONCLUSION:

Driver, Kirstin Green is fined $300.
