EVIDENCE:

Following the running of Race 10, Chief Stipendiary Steward, Mr Nigel McIntyre, presented an Information alleging a breach of Rule 869(3)(b) by Driver Ms Kirstin Green.

Ms Green stated she was conversant with the Rule, the charge and confirmed she admitted the breach.

Rule 869(3)(b) provides:

No driver in any race shall drive carelessly.

Mr McIntyre played all available videos of the incident and pointed to Ms Green racing 2 -wide at the 150m. He said at this juncture, Ms Green was held up for a run. He pointed to Ms Green at approximately the 75m, angle her horse out from behind her trail abruptly and in doing so, hampering WILLISON (A G Herlihy).

DECISION:

The Respondent having admitted the charge, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr McIntyre stated Ms Green had incurred a $200 fine for striking a wheel at Wyndham on 12 October 2023. He said this breach, being Ms Green’s second within the reset period, requires a 4-day starting point to be considered by the Adjudicative Committee.

Mr McIntyre advised the Adjudicative Committee Ms Green is regarded as a Southern Region Driver.

Ms Green made no submissions on Penalty.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 4-day suspension starting point for a second breach of this Rule.

The Adjudicative Committee can find no aggravating factors here and Ms Green’s professional manner and admission of the breach deserves a discount of 1 day.

Accordingly, the Adjudicative Committee finds a 3-day suspension to be an appropriate penalty in the circumstances of this case. Drivers are declared for the Winton meeting on 19 November and this suspension shall begin at the conclusion of that race day.

CONCLUSION:

Driver Ms Kirstin Green’s Licence to drive in races is suspended from the conclusion of racing on 19 November 2023, up to and including racing on 8 December 2023.
