EVIDENCE:

Following the running of Race 7, Stipendiary Steward Mr Paul Williams presented an Information alleging a breach of Rule 869(7A)(a) by Driver Ms Kirstin Green.

Ms Green stated she was conversant with the Rule, the charge and confirmed she admitted the breach.

Mr Williams played all available videos of the incident and pointed to Ms Green racing in the trail at the 250m. He said Ms Green has hit the last 2 track markers, which was confirmed on the video.

Ms Green made no comment, but confirmed her admission.

DECISION:

The Respondent having admitted the charge, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Williams said this breach would usually be dealt with by the MIN regime, but as this is a Group 2 Race, an Information was issued. Mr Williams said the appropriate penalty would be a $200 fine.

Ms Green made no submissions on penalty.

REASONS FOR PENALTY:

The Adjudicative Committee accepts Mr Williams’ submissions, as does Ms Green, and finds a $200 fine as appropriate in the circumstances of this case.

CONCLUSION:

Driver Ms Kirstin Green is fined $200.
