EVIDENCE:
Following the running of Race 3, Driver Kirstin Green denied a charge by Stipendiary Steward Mr Rick Quirk, in that she had breached the Pushout Rule.
Miss Green stated she understood the Rule, the Charge, and confirmed she did not admit the breach.
Mr Quirk had Mr Munro identify Miss Green (KAIRO) on the race video, racing in sixth place approaching the 1900m and Mr Mcllwrick (TICKTOCK MCGLAUGHLIN). Mr Munro used three video angles to show Mr McIIwrick positioned on the outside and past Miss Green’s wheel when improving.
Mr Quirk said from this juncture, Miss Green shifted out, dictating Mr McIIwrick out to be three wide, when she was not entitled to do so.
Miss Green said the horses in front of her, KRACKA KARMA (C Dalgety) and BLARNEY STONE (M Williamson) were racing a sulky width off the rail and when two horses galloped at the front of the race, those horses shifted in. She said she remained where she was, which gave the impression she pushed out Mr McIIwrick. Miss Green used the video to show Mr McIIwrick racing half a sulky width wider than the running line, which contributed to this impression.
Mr Quirk summed up the Stewards’ interpretation of the incident by saying the Rule is clear, a horse should not be forced wider on the track. He said Mr McIIwrick reached Miss Green’s wheel, where she dictated him to a three wide position.
REASONS FOR DECISION:
The video shows the alleged breach, which the Stewards say clearly demonstrates a breach of the Pushout Rule.
The Adjudicative Committee acknowledges the video does appear to confirm a breach; however, it considers Mr Dalgety and Mr Williamson have raced one off the rail until the two lead horses galloped, whereupon they have steered back to the fence, leaving Miss Green effectively in no man’s land.
The Adjudicative Committee agrees with Miss Green, confirmed clearly by the video, Mr McIIwrick was racing two and a half carts out at this point and tending to hang out. If racing was done in lanes, which it is not, Miss Green had a foot in lane 1 and 2, Mr McIIwrick a foot in lane 2 and 3. At this juncture, all the Drivers concerned would have had their eyes on the scatter of galloping horses from the front of the race and the Adjudicative Committee finds there is just too much going on here, to be completely satisfied apportioning the blame fully on Miss Green for TICKTOCK MCGLAUGHLIN being wider on the track.
CONCLUSION:
The Charge was dismissed.
