Penalty: Driver Kirstin Green is suspended for 3 days
Following the running of Race 5, the Cobbitty Equine Farm ‘Uncut Gems’ Mares Classic (Listed Race), the Respondent Open Driver Kirstin Green admitted a breach of Whip Rule 869(2). The particulars of the charge are that “when driving JUST LIKE JAGGER, she used her whip in a continuous manner over the concluding stages.”
Rule 869 provides that:
(2) No driver shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Respondent acknowledged she understood the Rule, nature of the charge and confirmed her admission of the breach.
Chief Stipendiary Steward Nigel McIntyre used available video footage to demonstrate the breach. He pointed out Ms Green driving JUST LIKE JAGGER racing in the lead position, as the field turned for home. Mr McIntyre showed that Ms Green used her whip over the early stages of the straight in a compliant manner, but from the 50m, used her whip in a continuous manner. He added that the strikes were of minimal force.
Ms Green stated that the strikes were of no force and only taps. She said that she uses the whip with the rein, which gets her into trouble and it was a bad habit she needed to get sorted.
Decision:
The charge is admitted and therefore proved.
Submissions for Penalty:
Mr McIntyre produced the Respondent’s record, which indicated a clear record in relation to this Rule over the prior 2 months. He said that Ms Green had driven on 124 occasions so far this season.
He submitted that this was a Listed Race, with the Penalty Guide providing a 3 day starting point for an initial breach of this Rule.
Ms Green made no submissions in regard to penalty, apart from making application for a deferment until after racing on 24 May 2026 at the Winton Harness Meeting.
Reasons for Penalty:
The Penalty Guide provides a 3-day suspension for an initial breach of this Rule in a Listed Race.
It was determined that there were no aggravating factors to consider, therefore no uplift was warranted.
After taking consideration of all factors, the Adjudicative Committee deemed a 3 day suspension, commensurate with the Penalty Guide, to be an appropriate penalty.
Conclusion:
Ms Green’s application for a deferment until after racing on 24 May 2024 is granted. Ms Green is suspended from the conclusion of racing on 24 May 2026, up to and including 1 June 2026.
Relevant meeting encompassed in the suspension are Addington – 29 May, Ashburton – 31 May and Invercargill – 1 June 2026.
