EVIDENCE:

Following the running of Race 2, the Hirepool 1600, Mr Williamson lodged an Information alleging that Mr A Goindasamy, the Rider of SAINT ALICE, committed a breach of Rule 638(1)(d) by riding carelessly.  It was contended that he “angled his mount inwards at the 1300m mark, when his mount was insufficiently clear of the horse ARANCIA which was hampered.

SUBMISSIONS:

Mr Dooley illustrated from the race films that when riding SAINT ALICE from an outside barrier draw, shortly after the start, Mr Goindasamy, after looking inwards, steered his mount inwards so that it angled towards ARANCIA ridden by Ms Spratt.  When insufficiently clear of that horse – being barely just over 1 length, he crossed Ms Spratt’s mount so that she was required to take a hold of ARANCIA and lose ground as it was hampered.

Mr Manning, on behalf of Mr Goindasamy, contended that the offence was at a low level, as a horse ahead of ARANCIA eased so as to require Ms Spratt to ease slightly, and her actions in restraining her mount exaggerated the effect of Mr Goindasamy’s actions.

REASON FOR DECISION:

Mr Goindasamy admitted the breach and it was therefore found proved.

SUBMISSION FOR PENALTY:

Mr Williamson submitted that the offence was low to mid range and that there were some mitigating factors.  He said that Mr Goindasamy had had 620 rides over the last 12 months, so was not inexperienced.  He described his record as “neutral” and advised that since October 2020 Mr Goindasamy had 3 separate suspensions for careless riding, involving (apart from fines), 6, 7, 8 days for low, mid and high range offending.

REASON FOR PENALTY:

We found the level of careless riding to be close to mid range as Mr Goindasamy’s actions were deliberate , and it was Ms Spratt’s experience that ensured the outcome was not serious.

CONCLUSIONS:

A suspension of 5 National Riding Days and a fine of $500 is imposed.  The suspension shall commence at the conclusion of racing today, 7 August 2021 and finish at the conclusion of racing on 20 August 2021.
