FACTS

Mr A Goindasamy admitted a breach of Rule 638(3)(g)(i).  The breach being that he used his whip excessively prior to the 100m (6 times), 5 is the limit.

Mr Goindasamy said that he understood the Rule, charge and confirmed that he admitted the breach.

Mr Coppins showed film replays and identified the 6 strikes applied prior to the 100m.

Mr Goindasamy said that as he was on the outside, he looked at the red tape on his outer and misjudged it.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

Mr Coppins said that Mr Goindasamy was fined $500 on 13 July 2022 for a whip breach for 6 strikes.  He said an aggravating factor today was that he won the race.  He added that the starting point was a $250 fine.

Mr Goindasamy said that he thought it would be more because he won the race.

REASONS FOR PENALTY

Mr Goindasamy’s record was taken into account, as was the fact that his mount “UNSCRIPTED” won the race narrowly by a short-head, this being a significant aggravating feature.

It was also noted that the breach had been admitted.

Taking all of these matters into consideration a fine of $500 was deemed to be a condign penalty.

CONCLUSION

Mr A Goindasamy was fined $500.
