FACTS

Mr Goindasamy admitted a breach of careless riding.  The carelessness being that, near the 300m Mr Goindasamy allowed his mount to shift outwards when not sufficiently clear of BOLEH (A Calder) which was crowded and checked.

Mr Goindasamy said that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Jones showed film replays which clearly showed Mr Goindasamy’s mount “JIMMY THUMPER” shifting out onto BOLEH (A Calder) which was crowded for room and then checked.  Mr Jones said that “JIMMY THUMPER” was a head to a neck clear when shifting.

Mr Goindasamy said that he and Mr Calder were going for the same gap and that he was going a little better.

DECISION

As the charge was admitted together with the film evidence, the charge was upheld.

PENALTY SUBMISSIONS

Mr Goindasamy’s record showed two prior breaches in the last 12 months:

7 August 2021          –           5 Days Suspension & $500 Fine

21 July 2021             –           4 Days Suspension & $300 Fine

Ms Selvakumaran placed the carelessness in the low to mid-range.

Mr Harris said that Mr Goindasamy had stepped up and has ridden some good winners and that he is good lad to work with.

REASONS FOR PENALTY

The Adjudicator placed the carelessness just below mid-range and adopted a starting point of a 6 riding day suspension.

Taking into account the relatively good record and the admission of the breach, a one-day discount was given.

PENALTY

As was requested by Mr Goindasamy, the suspension of his Apprentice Jockey’s Licence is to commence after racing on 4 June,  through to all racing on 11 June 2022 (5 riding days).
