FACTS

Mr Goindasamy the Rider of “POSTER BOY” admitted a breach of Rule 638(3)(g)(i).

It was alleged by the Applicant that Mr Goindasamy struck his mount 6 times prior to the 100m (5 is the limit).

Mr Goindasamy said that he understood the Rule, Charge and confirmed that he admitted the breach.

Film replays were shown with Mr Dooley identifying where the 6 strikes were applied.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

The record showed that Mr Goindasamy had two prior breaches within the last 6 months:

12.03.2022 – fined $250

23.04.2022 – fined $850 (Group 3 & won the Race)

REASONS FOR PENALTY

The Penalty Guide starting point for a third breach of the Rule is a fine of $500.

As there were not any aggravating features, a fine of $500 was considered a suitable penalty.

Mr Goindasamy and Mr Manning did not comment regarding penalty when given the opportunity to do so.
