Evidence

Following the running of Race 10 the Respondent, Mr Jeetesh Mudhoo admitted a charge alleging excessive use of the whip prior to the 100 metre mark.

Rule 638 (3)(g)(i) provides that in Flat Race a rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins).

Using the available films, Stewards demonstrated that Mr Mudhoo struck his mount (ALMERAKI) on six occasions from the top of the straight to the 100 metre mark. It is worthy of note that Mr Mudhoo was afforded the benefit of the doubt in relation to an additional strike on or about the 100 metre mark.

When asked for comment Mr Mudhoo did not offer explanation beyond accepting the number of strikes demonstrated.

Decision

As the Respondent admitted the breach the Adjudicative Committee finds the breach proved.  Rule 915(1)(d) – refers

Submissions for Penalty

Mr Coppins referred to the NZTR Revised Penalty Guidelines for Whip Rule and Careless Riding Rule breaches implemented from 1 March 2022.

The Committee was informed of that warning Mr  Mudhoo received at  the the Otaki meeting on 9 March 2022. Same was issued as a result of a breach of the same Rule.

Reasons for Penalty

The Penalty Guide provides clear direction in respect of penalty starting point for breach of this type. In relation to a 2nd offence (within a six months period) given 1 additional strike (6 in total)  same is set at $250.

After considering film evidence and submissions  the Committee determined that there was no compelling reason to depart from the starting point set out in the Penalty Guide. On that basis the Respondent is fined $250.

Conclusion

Apprentice Jockey, Jeetesh Mudhoo is fined a sum of $250.
