Penalty: Apprentice Jockey Jeetesh Mudhoo suspended for 2 days and fined $500

FACTS:

Mr Mudhoo admitted a breach of Rule 638(3)(g)(i).

It was alleged that he used his whip excessively prior to the 100m.

Mr Mudhoo said that he understood the Rule, charge and confirmed that he admitted the breach.

Film replays showed that Mr Mudhoo struck his mount 6 times prior to the 100m (5 is the limit).

DECISION:

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS:

This was Mr Mudhoo’s fourth whip breach since 9 March with the Penalty Guide starting point being 2-Days Suspension plus a $500 Fine.

Ms Clapperton said that it was misjudgment on Mr Mudhoo’s part.

REASONS FOR PENALTY:

Mr Mudhoo has a poor record; 4 breaches in just over 3 months would not be considered an enviable record to have.  The Penalty Guide starting point was considered to be the appropriate penalty.

CONCLUSION:

Mr Mudhoo’s Apprentice Jockey’s Licence was suspended from the end of racing on 28 August through to and including 1 September 2022 (2 days) and a $500 fine imposed.
