Outcome: Protest Upheld

Penalty: Disqualification of LAURIES LEGACY

An Information was lodged by Miss Haley under r 870(3) and Breaking Horses Regulations alleging that LAURIES LEGACY galloped in excess of 50 metres in the final 200 metres in Race 6.

Judge’s placings were:

1ST        6   AVEROSS MAJESTY

2ND       2    DOMINATION’S CALL

3RD      7     LAURIES LEGACY

4TH       3     SHANDON BELLS

5TH      1     BOYZ INVASION

Miss Haley demonstrated on the videos that LAURIES LEGACY broke and galloped for over 60 metres to the winning post.

Mr Williamson, the Driver of LAURIES LEGACY, indicated that he represented the connections of the horse and did not contest the protest.

The Adjudicative Committee has viewed the videos and is satisfied that some 10 metres before the 50-metre mark LAURIES LEGACY has gone into a break and has continued in a gallop to the winning post. The horse was free of interference at the time. The Breaking Horses Regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.

As LAURIES LEGACY has gained an advantage over the field it is appropriate that the horse be disqualified.

Amended placings are:

1ST       6   AVEROSS MAJESTY

2ND      2   DOMINATION’S CALL

3RD     3    SHANDON BELLS

4TH      1   BOYZ INVASION

5TH      4   BRIGHT GLOW

Stakes and dividends are to be paid accordingly.
