Penalty: Driver Brad Williamson is fined $200

EVIDENCE:

Mr Ydgren showed the video of the prestart and identified Mr Williamson driving JIMMY CARTER which had drawn unruly 2 off 10 metres. Mr Ydgren pointed to Mr Williamson turn his horse to face up the track and begin to jog at speed towards the 10 metre barrier. He said as result the Starter Mr R Donnelly has not released the field as the speed Mr Williamson has approached the tapes would have given him an advantage over other runners and the start was delayed.

Mr Ydgren said Mr Williamson’s actions have delayed the start which has consequences for the Club especially the turnover in Australia.

Mr Williamson made no submissions.

REASON FOR DECISION:

Mr Williamson had admitted the breach and accordingly, it was proved.

SUBMISSION FOR PENALTY:

Mr Ydgren stated that on 10 August 2021 the Horseman’s Association and HRNZ were notified that the penalty recommendation would be a fine of $200 where the Driver admits the breach.

REASON FOR PENALTY:

Mr Williamson told the Committee he had seen the correspondence from the RIB on Penalty for this Rule. This is the first charge under the new Guidelines and the Committee is satisfied a $200 fine is appropriate in this case.

CONCLUSIONS:

Mr Williamson is fined $200.
