Penalty: Driver Brad Williamson is fined $100

EVIDENCE:

Following the running of Race 6, Stipendiary Steward, Paul Williams presented an Information alleging a breach of Rule 869(7A)(a) by Driver, Brad Williamson.

Mr Williamson stated he understood the Rule, the charge and confirmed he admitted the breach.

Rule 869(7A)(a) provides:

(7A) Every driver who moves inwards shall ensure:

(a) that contact is not made with any track marker.

Mr Williams showed the video of the horses rounding the final bend to show Mr Williamson racing on the markers. He pointed to Mr Williamson’s sulky wheel, which struck two track markers in a row.

Mr Williamson elected to make no submissions on the incident.

REASONS FOR DECISION:

As Mr Williamson has admitted the breach, the charge is found proved.

SUBMISSIONS FOR PENALTY:

Mr Williams stated that the Respondent was warned on 23 April and 2 July 2023 for striking track markers. He said the Stewards would be seeking a fine of $100. He added that this breach will be covered under the MIN system with a fine of $100.

Mr Williamson elected to make no submissions on penalty.

REASONS FOR PENALTY:

This type of incident is soon to be covered by the MIN regime with the penalty being a $100 fine. The Adjudicative Committee deemed that this was an appropriate penalty for this case.

CONCLUSION:

Respondent, Brad Williamson, is fined the sum of $100.
