FACTS

Ms T Mitchell admitted a breach of Rule 638(3)(g)(i).  The breach being that Ms Mitchell struck her mount “BUTLER” 6 times with the whip prior to the 100m (5 is the limit).

Ms Butler said that she understood the Rule, Charge and confirmed that she admitted the breach.

Mr Jones showed film replays and identified the 6 strikes being applied.

Mr Harris and Ms Mitchell agreed.

DECISION

As the breach was admitted it was deemed proved.

PENALTY SUBMISSIONS

Ms Mitchell’s record showed four prior breaches of the Rule in the last six months.

The two most recent being on 7 July 2022 when a fine of $500 was imposed for one breach, with a six day suspension imposed for the other breach.

Mr Jones referred to the Penalty Guide which had a starting point of 5-Days plus for a 5th breach of the Rule.

Ms Mitchell said that she was riding a $1.40 favourite and felt some pressure.

Mr Harris said that the whip use was not aggressive and that Ms Mitchell is a neat and tidy Rider and just has to learn to count correctly.

REASONS FOR PENALTY

Ms Mitchell has an unenviable record for one who had only had 73 raceday rides prior to today’s meeting.

Taking into account all matters relating to penalty, it was determined that a 7-day suspension was a condign penalty.

CONCLUSION

Ms T Mitchell’s Apprentice Jockey’s Licence was suspended from 28 July up to and including 12 August 2022 (7 National Riding Days).
