FACTS:

Apprentice Jockey Tayla Mitchell, assisted by Senior Rider Jasmine Fawcett (replacing the Apprentice Riding Mentor), admitted a breach of the Whip Rule in that she struck her mount 7 times prior to the 100 metre mark.

She also stated that she understood the Rule and was aware of the Penalty Guidelines for the breach.

The films of the incident were shown and all parties counted and confirmed the number of strikes.

Both Stipendiary Steward N Goodwin and Apprentice Jockey T Mitchell had nothing to add.

DECISION:

As the charge was admitted, it was deemed proved.

SUBMISSIONS ON PENALTY:

Stipendiary Steward N Goodwin asked for an uplift from the Penalty Guidelines for this breach as FONSI went on to win the race.

Apprentice Jockey T Mitchell had no comment.

REASONS FOR PENALTY:

It was noted that the winner’s purse was $10,360 and it was deemed appropriate that even though the charge was admitted and it was her first breach, an uplift was warranted as her mount won the race.

CONCLUSION:

Apprentice Jockey T Mitchell was fined $600.
