Facts

Apprentice Jockey T Mitchell confirmed she admitted a breach of Rule 638(1)(d) in that she allowed her mount NO TIME TO JAZZ, to move inwards on the point of the bend, tightening and causing Jockey W Kennedy to take hold of his mount ELCHEIKHALI, resulting in that horse having to be checked.

The films of the incident were shown and Stipendiary Steward N Goodwin, pointed out that in moving inwards on the point of the bend, her actions caused Jockey W Kennedy to take hold.

Jockey T Mitchell, while agreeing interference did take place, believed it was at the lower end of the scale and in following Jockey W Kennedy across to the rail, she simply misjudged the distance. Riding Mentor K Clapperton agreed with her comments.

Decision

As the charge was admitted, it was deemed proved.

Submissions on Penalty

Stipendiary Steward N Goodwin informed the Adjudicative Committee that this was Jockey T Mitchell’s first breach of this Rule.

She is a busy Rider in the short time she has been riding. He believed the incident was at the low end of the scale.

Jockey T Mitchell had nothing to add except to ask for a deferment  to allow her to fulfill obligations in the next week.

Reasons for Penalty

In coming to its decision to impose a period of suspension for the breach, the Adjudicative Committee agreed to a deferment and took into account the admittance of the breach, the belief it was at the lower end of the scale and the fact it was her  first breach of the Rule in her relative short, but busy time in the saddle.

Conclusion

A 4-day suspension was imposed, beginning after the end of racing on Saturday 18 February, and ending after the completion of racing on Friday the 24th of February.
