Penalty: Jockey Jasmine Fawcett is suspended for 5 days

Following the running of Race 5, the Respondent Class A Rider Ms J Fawcett admitted a charge alleging excessive whip use prior to the 100 metres.

The Information alleged that Ms Fawcett struck her mount (DIAMOND JAK) 8 times prior to the 100 metres.

Rule 638(3)(g)(i) provides that in a Flat Race a Rider must not:

(i) strike a horse with a whip more than 5 times prior to the 100-metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); or

Using the available race films, Senior Stipendiary Steward Mr J Oatham identified DIAMOND JAK (J Fawcett) who had raced to the lead after entering the home straight.  He pointed out that from the straight entrance to the 100-metre mark, Ms Fawcett struck her mount 8 times, with one strike ocurring between the 100m and the finish post.

Ms Fawcett said the Guidelines are clear, but asked if the Adjudicative Committee could take into consideration that she only struck the horse once inside the last 100m.

Decision

As Ms Fawcett admitted the breach, the Adjudicative Committee finds the breach proved.

Submissions for Penalty

Mr Oatham advised that Ms Fawcett has had only 1 breach in the previous 6 months. This occurred on the same horse at Te Rapa on the 27th of July, on that occasion incurring a $500 fine.

Mr Oatham submitted that the Penalty Guide provides for a 5 day suspension for a breach of this nature. He added that the Adjudicative Committee might like to consider that Ms Fawcett won the race, albeit by 1.25 lengths.

Ms Fawcett said that she was a busy Rider and she didn’t like letting people down through being suspended. Ms Fawcett said she would take any proposed suspension immediately.

Reasons for Penalty

The Penalty Guide starting point for a breach of this nature, is a 5 day suspension.

The Adjudicative Committee was cognisant of the fact that Ms Fawcett won the race, however given the nature and the margin of the win, didn’t believe that the whip breach was a factor in the outcome of the race.

Conclusion

Class A Rider Ms Fawcett is suspended for 5 days.

The suspension commences after racing on 24/8/24 and concludes after racing on 4/9/24.
