BACKGROUND:

Following the running of Race 6, Ms J Fawcett (Class A Rider) admitted using her whip in an action above shoulder height.

Rule 638(3)(f)(ii) provides:

Without limiting the generality of subrule 638(3), in a Flat Race . . . A Rider must not use his / her whip:

(ii)  using an action that raises the Rider’s arm above shoulder height.

EVIDENCE:

Senior Stipendiary Steward Mr A Dooley demonstrated that in the home straight, Ms Fawcett struck her mount LEVAKIA using an action with her arm raised above shoulder height on four occasions.

LEVAKIA won the race.

Ms Fawcett freely admitted the breach and agreed with the number of strikes. She stated that her use of the whip above shoulder height is something she needs to work on.

DECISION:

As Ms Fawcett admitted the breach, the Adjudicative Committee finds the charge proved.

SUBMISSIONS ON PENALTY:

Mr Dooley advised the Adjudicative Committee that Ms Fawcett has a record of two prior breaches of Rule 638(3)(f)(ii) within the reset period. Both of these breaches occurred on 16 November 2025. Ms Fawcett was fined $350 and $450 respectively for each breach.

The Penalty Guideline is for a fine of $250 for a first offence. However, Mr Dooley considered an uplift from the $250 starting point was required as this was Ms Fawcett’s third breach and her mount won the race.

Ms Fawcett had nothing to add concerning penalty.

REASONS FOR PENALTY:

The Penalty Guide provides for a $250 for a first breach of the Rule. Further breaches are dealt with on a fact dependent basis.

This is Ms Fawcett’s third breach. Aggravating factors are that four strikes above shoulder height were applied and her mount won the race.

Accordingly, an uplift is applied and a fine of $550 is imposed.

CONCLUSION:

Ms Fawcett is fined $550.
