SUMMARY OF FACTS:

Following the running of Race 4, the Skycity Hamilton – Open @ Level 2 1200, Mr Oatham presented an Information alleging that Mr R Beemud, the Rider of GAME NIGHT, committed a breach of Rule 638(3)(g)(i) in that he struck his mount more than 5 times prior to the 100 metre mark.

SUBMISSIONS:

Mr Oatham demonstrated, from the race film that Mr Beemud struck his mount 7 times during the running prior to reaching the 100 metre mark.

Mr Harris said that this was Mr Beemud’s first ride since lockdown in early October and has had limited opportunities to ride as an inexperienced  Apprentice.

REASON FOR DECISION:

As Mr Beemud admitted the charge it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Oatham advised them Mr Beemud has had 28 rides without any breaches of the Whip or other Rules.

REASON FOR PENALTY:

Applying the Penalty Guide starting point for a first offence breach of the Whip Rule prior to the 100 metre mark, Mr Beemud is fined $250.  His mount was unplaced so any share of the stake (for horses finished between 6th and 10th) was a minimal $20.

CONCLUSIONS:

Apprentice Jockey Rahul Beemud is fined $250.
