Penalty: Apprentice Jockey Rahul Beemud is fined $500

SUMMARY OF FACTS:

Following Race 11 Mr Beemud admitted a breach of Rule 638(3)(g)(i) in that he struck his mount “DAWN JESSIE” 9 times with the whip prior to the 100m (5 being the limit).

Mr Beemud said that he understood the Rule and the charge.

EVIDENCE:

Film replays were viewed which confirmed that Mr Beemud had struck “DAWN JESSIE” with his whip 9 times before reaching the 100m.

Mr Beemud and Mr Harris who assisted Mr Beemud, agreed that it was 9 strikes.

REASON FOR DECISION:

Due to Mr Beemud admitting the breach and the film confirmation, the charge was found proved.

SUBMISSION FOR PENALTY:

Mr Oatham advised that Mr Beemud had one prior breach of the Rule and referred to the Penalty Guide starting points.

Mr Harris said that Mr Beemud had ridden 4 winners in recent times, that his riding had improved and that he is a good pupil at the Riding School.

REASON FOR PENALTY:

The Penalty Guide has a starting point of a $500 fine for a second breach of the Rule within 6 months.

As there were no aggravating matters to consider, $500 was deemed to be an appropriate penalty by the Adjudicative Committee.

CONCLUSIONS:

Mr Beemud was fined $500.
