SUMMARY OF FACTS:

Following the running of Race 5, the Dunstan Recovery Mash 1200, Mr Jones presented an Information charging Mr V Colgan, the Rider of NETANYAHU with a breach of Rule 638(3)(g)(i) in that he struck his horse more than 5 times prior to the 100 metre mark.

SUBMISSIONS:

Mr Jones demonstrated from the race film that Mr Colgan, whilst his mount NETANYAHU was leading in the home straight he struck it with his whip 6 times before the 100 metre point. The horse finished second earning a stake of $2,700.

REASON FOR DECISION:

As Mr Colgan admitted the breach of the Rule, it was deemed proved.

SUBMISSION FOR PENALTY:

Mr Colgan had 2 previous breaches of Rule 638 over the past month (on 2 September he was fined $250 for striking his mount 7 times, and on 4 September 2021 he was suspended for 5 days and fined $150 – which was for a breach of Rule 638(3)(g)(ii), namely for consecutive strikes).

REASON FOR PENALTY:

Mr Colgan has committed rides over the next 10 days, and accordingly within the Rules the following suspension can be deferred within that period.

CONCLUSIONS:

His Licence to ride is, in terms of the Penalty Guide, suspended for 5 National Riding Days to commence at the conclusion of racing on 9 October and to end at the conclusion of racing on 16 October 2021.  In addition he is ordered to pay a penalty of $150.
