EVIDENCE:

Mr Jones presented Information A17160 alleging that Mr Colgan struck his mount “BLOOD WARRIOR” (1st) with the whip on two consecutive strides over the concluding stages.

Mr Colgan said that he understood the Rule, charge and confirmed that he admitted the breach.

The film replays were shown with Mr Jones identifying where Mr Colgan struck his mount on two consecutive strides near the conclusion of the race.

Mr Colgan said that it was clear on the film.

REASON FOR DECISION:

As the charge was admitted it was found proved.

SUBMISSION FOR PENALTY:

Mr Jones produced Mr Colgan’s record which showed three previous whip breaches during the last 6 months.  He said that a similar breach when the horse also won resulted in the Rider receiving a 5-Day Suspension. He added that the Penalty Guide did not address a fourth breach of the Rule.

Mr Colgan in essence said that he did not mean to do it and that he did not hit his mount again.  Mr Colgan said that it was difficult not to do it as the temptation is always there when rolling along.

After discussing penalty options, Mr Colgan preferred a suspension.

REASON FOR PENALTY:

All matters relating to penalty were addressed by the Committee.  Whilst the Guidelines relating to a fourth breach of the Rule is silent, the Committee for reasons of consistency determined that a 5-Riding Day Suspension was a suitable penalty.

CONCLUSIONS:

Mr Colgan’s Jockey’s Licence was suspended from the end of Racing on 4 December up to and including racing on 16 December 2021.
