FACTS

Following Race 6, Information A15595 was filed with the Adjudicative Committee.

It was alleged that Mr V Colgan the Rider of “FARAGLIONI”, allowed his mount to shift inwards when insufficiently clear of “MY FATHER’S GUN” (K Hercock), which was checked near the 800m.

Mr Colgan confirmed that he admitted the breach and understood the Rule and charge.

EVIDENCE

Mr Goodwin showed film replays and identified the horses and Riders involved.

He said racing towards the 800m, Mr Colgan was 3-wide outside Ms Hercock.

He said he then shifted in when not clear, with Ms Hercock having to take a hold.

Mr Goodwin added that the leader “ROYAL FLOWER” may have contributed when not cornering very well, but the main contributor was Mr Colgan and his mount.

Mr Colgan said that there was gradual movement from him and he thought that he was clear. He said that he did not want to take the leader on, and that he came in a little and that Ms Hercock had to take a hold.  Mr Colgan said that if he had gone on for another stride he would have been clear.

DECISION

As the breach was admitted, it was deemed proved.

PENALTY SUBMISSIONS

The record showed that in the last 12 months Mr Colgan had had 288 rides with three breaches of the Rule.

The Stewards placed the carelessness in the low-range.

Mr Colgan wanted a deferment until after 26 November.

REASONS FOR PENALTY

The Adjudicative Committee determined that the incident was in the low-range with a starting point of 5-days suspension.  A 1-day discount was afforded for the admission of the breach.

CONCLUSION

Mr Colgan’s Jockey’s Licence was suspended after racing on 26 November through to all racing on 2 December 2022 (4 National Days).
