Following Race 10 a Protest against the 4th placing of JAY ROWE was instigated on the basis that the horse had broken and galloped in excess of 50 metres within the final 200 metres.
Mr D Balle, a Licensed Trainer/Driver appeared at the hearing on behalf of the connections who were unavailable. Mr Balle noted on the Information that he did not contest the protest.
The Breaking Horses Regulations provide that ‘Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its proper gait’.
Mr Dooley identified JAY ROWE early in the run home. The horse was challenging when at about the 75 metres mark it went offstride and continued to gallop for approximately 65 metres. It regained its gait near the finish and was in 4th place at the line.
The horse was clearly in breach of Rule 870(3) and the Breaking Horses Regulations.
JAY ROWE was disqualified from its 4th placing.
The amended placings became:
1st CON GRAZIA LOVE
2nd DEBBIE LEE GALLEON
4th PRINCE ENVY
5th MY HOPE
Authority was given for payment of dividends and stakes as per the above placings.
