Evidence:

The Applicant, Stipendiary Steward Brady Jones, filed an Information pursuant to Rule 346(3) alleging that Class A Rider Craig Grylls, failed to make the carded weight for CONTRIBUTE and was replaced.

The Respondent was present at the hearing and confirmed his admission of the breach.

Rule 346(3) provides:

“A Rider shall not fail to ride a horse at the weight at which it is handicapped to carry”. 

Stipendiary Steward Mr Jones advised that in Race 6, CONTRIBUTE was handicapped to carry 53kg but this morning, Mr Grylls advised he would not be able to make the weight. He was replaced by Ms Ciel Butler as there were no Senior Riders able to make the weight. Ms Butler has ridden the horse previously and Trainer Mr Patterson, was happy to have her on.

By way of explanation, the Respondent said he had recently been suffering from a cold and despite sweating, had been unable to get down to correct weight.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved.

Submission for Penalty:

Mr Jones advised the Respondent had 1 charge in the last 120 days, where he was fined $100 on January 21st. He said breaches are normally dealt with by way of Minor Infringement Notice (MIN), but due to the Group 3 status of the race, Stewards elected to proceed by way of an Information, as opposed to having the matter dealt with by way of MIN.

Reasons for Penalty:

The MIN Schedule establishes a $200 fine as the starting point for a second breach of this Rule.  In circumstances where Stewards elect to file an Information, determination of penalties are fact dependent.

The Adjudicative Committee agreed that the status of the race was an aggravating factor and determined that an uplift was warranted.

Conclusion:

The Respondent is fined $350.
