SUMMARY OF FACTS:

The Information alleged a breach of Rule 638 (3) (g) (i) in that C Grylls used his whip excessively prior to the 100m on VERNANME.

At the outset of the hearing, Mr Grylls confirmed he understood the Rule and admitted the breach.

EVIDENCE:

Mr Oatham played the head-on video and identified Mr Grylls racing adjacent to the running rail. While vying for the lead he drew his whip and struck his mount 6 times prior to the 100m mark eventually finishing in third place. Mr Grylls accepted that he had struck his mount one more time than allowed under the current Guidelines.

REASON FOR DECISION:

Mr Grylls admitted the breach, therefore the charge was deemed proved.

SUBMISSION FOR PENALTY:

Mr Oatham said Mr Grylls had a clear record under this Rule for the preceding 12 month period. He submitted that today’s breach was low end with the last strike coming very close to the 100m mark.

REASON FOR PENALTY:

The Committee was satisfied that this was a low end breach being one over the 5 strikes allowed. Taking into account Mr Grylls’ clear record and the current Penalty Guidelines a fine of $250 is appropriate.

CONCLUSIONS:

Accordingly Mr Grylls is fined the sum of $250.
