Penalty: Apprentice Jockey Amless Bohorun is fined $500

Evidence:

Following the running of Race 6, an Information was lodged alleging a breach of Rule 638(3)(g)(i) – being worded as:

in that he used his whip excessively prior to the 100m (8 times).

This rule requires that a rider must not:

except as provided for in (ii) and (iii) of this sub rule, strike a horse with a whip more than 5 times prior to the 100-metres mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins); 

Mr Bohorun confirmed to the Adjudicative Committee that he understood the Rule and admitted the breach.

Using available film, Stewards were able to identify 8 strikes between the top of the straight and the 100 metre mark. Mr Bohorun confirmed that he agreed with the count.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Stewards referred to the Respondent’s record – as it related to any breach of this Rule within the last 6 months. In respect of this particular Rule, his record is clear. Stewards referred the Adjudicative Committee to the current Penalty Guideline. Same provides for a fine of 500 in this particular circumstance.

Reasons for Penalty:

On balance, given the circumstances of the breach, the Adjudicative Committee found no reason to depart from the aforementioned Guideline. As such, a fine of $500 was imposed.

Conclusion:

Apprentice Jockey Mr Amless Bohorun is fined a sum of $500.
