Penalty: Apprentice Jockey Amless Bohorun is suspended for 6 NR Days

Background:

Following the running of Race 8, the Nelson Pine 1600, an Information was lodged alleging a breach of Rule 638(3)(g)(i) – being worded as follows:

struck his mount ‘Tequila Spirit’ ten times prior to the 100 metre mark

The Rule requires that a Rider must not:

except as provided for in (i) and (ii) of this sub rule, strike a horse with a whip more than 5 times prior to the 100 metre mark (other than in a slapping motion down the shoulder with the whip hand remaining on the reins);

Mr Bohorun confirmed to the Adjudicative Committee that he understood the Rule and that he admitted the breach. This was endorsed by Ms Clapperton.

Evidence:

Using available film, Stewards were able to identify 10 ten strikes from just prior to the top of the straight and the 100 metre mark. Mr Bohorun confirmed that he agreed with the count.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Stewards referred to the Respondent’s record – as it relates to any breach of this Rule within the last 6 months.  There was 1 breach noted namely:

Taranaki RI 22/7/2023 – 8 strikes prior to 100m – $500 fine.

Stewards referred the Adjudicative Committee to the current Penalty Guide. In circumstances of 2nd offence – 4 or more additional strikes – a suspension of 5+ national days is provided. Mr Bohorun advised that any suspension imposed could start immediately.

Reasons for Penalty:

On balance, given the circumstances of the breach, the Adjudicative Committee considered a 6 day suspension was appropriate.  In setting penalty, that meeting scheduled for Rotorua on 20/8/2023 (subsequently rescheduled to 22/8/2023) was not included, given that same is restricted to Jumps and Highweight Racing.

Conclusion:

Mr Bohorun’s Licence to ride in races is suspended from the close of racing on 19th August 2023, up to and including 30th August 2023 – effectively 6 days.
