Penalty: Apprentice Jockey Amless Bohorun is suspended for 4 days

Evidence:

Following the running of Race 4, the Respondent Mr A Bohorun admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).  The Information alleged that A Bohorun (CATSACHARMER) allowed his mount to shift inwards nearing the 100 metres tightening MORMAIRE (T Comignaghi), which had to check, and switch outwards to improve.

Mr Bohorun acknowledged he understood the Rule and confirmed his admission of the breach. Apprentice Mentor Ms K Clapperton was present to assist.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available race films, Stipendiary Steward Mr Goodwin demonstrated the incident and identified the horses and Riders concerned.

Mr Bohorun was in front on the turn. On straightening for home, he rolled off the fence presenting a gap on his inside for Ms Comignaghi. She proceeded to improve to the inside and was well established in the gap, when Mr Bohorun shifted back inwards into her line. She had to check briefly and change her line of running. Mr Goodwin said there was a reasonable chance Ms Comignaghi could have finished in a higher placing had she had a clear run. Neither runner finished in the first 5.

In response, Mr Bohorun said he heard someone calling behind him and he was trying to straighten his horse, but it was hanging badly.

Decision:

As the Respondent admitted the breach, the Adjudicative Committee finds the breach proved

Submission for Penalty:

Stipendiary Steward Mr K Coppins said Mr Bohorun had been riding for 4 years and had never been charged with careless riding over 404 rides.

He said said Stewards assessed the level of carelessness to be in the low-mid range.

Mr Bohorun said any suspension could begin after racing tomorrow as he had no confirmed rides beyond that day.

Reasons for Penalty:

After considering all submissions, the Adjudicative Committee determined Mr Bohorun’s carelessness to be just above low range and adopted a 6 day suspension as the starting point. This conforms with the NZTR Penalty Guide (as of 1 March 2022).

The available films clearly established that Mr Bohorun had allowed his mount to move inwards and as a result, Ms Comignaghi was forced to change her line of running. She was well established to the inside of Mr Bohorun and while he did make some attempt to straighten, he could have done more.

The Respondent’s riding record is exemplary, with this being the first careless riding charge in a 4 year riding career.

After consideration of all factors, a 4-day suspension was considered appropriate.

Conclusion:

Mr Bohorun’s  licence to ride in races is suspended for a period of 4 days, commencing after racing on 30/10/22 and concluding after racing on 5/11/22.
