Penalty: Class B Jockey Lemmy Douglas is suspended for 5 days

Evidence:

Following the running of Race 8, the “NEXT RACEDAY SATURDAY 23RD JULY MAIDEN”  Mr Oatham presented an Information charging Mr Douglas with a breach of Rule 638(3)(g)(i) – the “Whip Rule”.

The details of the breach were that Mr Douglas struck his mount “RONIN POROTENE”  8 times with the whip prior to  reaching the 100 metre mark.

Decision:

As Mr Douglas admitted the charge, it was deemed proved.

Submissions for Penalty:

The race film demonstrated that Mr Douglas’ mount “RONIN POROTENE”  challenged for the lead at the 400 metre mark, and was then struck with the whip 8 times by Mr Douglas before reaching the 100 metre mark.  The horse fought on to finish 3rd.

Reasons for Penalty:

Mr Douglas has had 2 breaches of this Rule over the past 6 months.

He, assisted by Ms K Clapperton, made no submissions as to penalty.

In line with the Guide, a suspension is appropriate for a third offence.

Conclusion:

Mr Douglas’ licence is suspended for 5 National Racing Days, to commence today, 1 July 2022, and to end at the conclusion of racing on 9 July 2022.
