Penalty: Apprentice Jockey Lemmy Douglas is fined $250

Mr L Douglas advised that he did not wish to be present or to have anyone represent him.  He waived his right to attend and to have representaqtion under Rule 915(9).

Evidence:

Following the running of Race 1, “The Riccarton Park Function Centre Rating 75”, Mr Oatham presented an Information charging Mr L Douglas with a breach of Rule 638(3)(g)(i) in that he struck his mount “DUNHILL” 6 times prior to reaching the 100 metre mark.

Mr Douglas admitted the breach.

Mr Oatham demonstrated by reference to the race films, that from about the 400 metre mark to just before the 100 metre mark, Mr Douglas, whose mount was in contention, struck the horse 6 times with the whip.  The horse finished second.

Decision:

As the charge was admitted, it was deemed proved.

Submissions for Penalty:

Mr Oatham advised that Mr Douglas, apart from receiving a warning for breaching the Whip Rule on 22 March 2023, had a clear record.

Reasons for Penalty:

The Adjudicative Committee sees no reason to depart from the Penalty Guide.

Conclusion:

Accordingly, Mr Douglas is fined $250.
