Penalty: Apprentice Jockey Lemmy Douglas is suspended for 2 days and fined $500

EVIDENCE:

Following the running of Race 2, an Information was presented by Stipendiary Steward Ms Veronica Algar alleging a breach of Rule 638(3)(g)(i) by Apprentice Jockey Mr Lemmy Douglas.

Mr Douglas confirmed he was conversant with the Rule, he understood the Charge and he admitted the breach. Mr Douglas was assisted at the hearing by Apprentice Mentor Mr David Walsh.

Ms Algar showed the video replays of the final straight with Mr Douglas leading the field, where upon he has struck his horse 6 times.

Mr Douglas and Mr Walsh made no comment.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Ms Algar stated Mr Douglas has now had 3 previous breaches of the Rule.

The first, a warning at Auckland on 22 March 2023 for 6 strikes.

The second, at Riccarton on 22nd April 2023, where he was fined $250 for 6 strikes prior to the 100m.

The third, in the first race today, where he was suspended for 5 days.

Ms Algar alluded to the Thoroughbred Racing Penalty Guide which has a 2 day suspension plus a $500 fine indicated for a 4th breach with 1 additional strike.

Mr Douglas and Mr Walsh made no submissions on Penalty.

REASONS FOR PENALTY:

The Penalty Guide provides a 2-day suspension plus a $500 fine for a 4th breach with 1 additional strike, and the Adjudicative Committee sees no reason to depart from the Guidelines in the circumstances of this case.

CONCLUSION:

Apprentice Jockey Mr Lemmy Douglas is suspended from the 3rd of June to the 4th of June 2023 inclusive, and in addition to this suspension, is fined $500.
