Penalty: Class A Rider A Tina Comignaghi is suspended for 5 days

Mr Davidson alleged that Ms Comignaghi rode carelessly in Race 9, in that she allowed her mount to shift outwards when not fully clear of ZADANE, which was crowded and checked near the 150 metres.

Mr Munro demonstrated on the videos that Ms Comignaghi (STOUT) shifted out early in the home straight looking for a run. Her mount went too far, and she shifted into the line of ZADANE. Mr Davidson added that Ms Comignaghi had tried to straighten her mount, but she had caused interference to ZADANE.

Ms Comignaghi said STOUT was hanging and she had tried to straighten the horse, but she had been too late.

Decision

As Ms Comignaghi has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which showed 1 breach of this Rule in the past 12 months. This was in a Group 3 Race and was almost 12 months ago. Mr Davidson described the breach as low to mid-range.

Ms Comignaghi stated she accepted Mr Davidson’s submissions and wished the suspension to start immediately.

Reasons for Penalty

Ms Comignaghi has shifted ground outwards early in the home straight, when not her length and another clear of ZADANE and has caused interference to that horse. The breach is correctly categorised as low to mid-range. From a 6-day starting point, there is a one-day reduction for admission of the breach and Ms Comignaghi’s record, which is very good considering the fact she is a busy Rider.

Conclusion

Ms Comignaghi is suspended from the end of racing today, up to and including Sunday 21 December 2025. This is 5 national riding days.
