EVIDENCE:
Following the running of Race 9, the WINNING EDGE PRESENTATIONS 128TH WINTER CUP, Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(3)(g)(i) by Jockey Miss Tina Comignaghi.
Miss Comignaghi stated she was conversant with the Rule and the Charge and confirmed her admission of the breach.
Mr Oatham played the home straight video to identify Miss Comignaghi (CHASE) finishing down the inside of the track. He counted 7 strikes prior to the 100m and followed by 4 more before the winning post.
Miss Comignaghi said she had miscalculated, as she had got so excited winning this race.
DECISION:
The Respondent having admitted the breach, the charge was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Oatham said Miss Comignaghi was warned on 3 July at Ashburton, where she struck her mount 6 times prior to the 100m and 5 times after. He said the starting point for this second offence is a $500 fine, however, the Black-Type Group 3 rating of this race brings into play, the Jockey’s percentage regime.
Miss Comignaghi, when asked to make comment on this, said “that hurts.”
REASONS FOR PENALTY:
The General Whip Penalty Provisions states” with regard to breaches of Whip Rules 638(3)(g)(i) and 638(3)(g)(ii) in any Black-Type race, the starting point for a fine will be the amount equal to 50% of the Jockey’s share of the stakes earned by their mount or the starting point on the penalty table, whichever is greater, and may be in addition to any suspension imposed.”
Miss Comignaghi’s percentage for this race is $3,160, of which 50% equals $1,580. Had she resisted giving her horse the last strike, which she admitted was needless as the race was well and truly won, there would be no charge.
The Adjudicative Committee, having regard for all the evidence, considers a $1,500 fine to be condign in the circumstances of the case.
CONCLUSION:
Jockey Tina Comignaghi is fined $1,500.
