Penalty: Class A Rider Lee Callaway is suspended for 5 days

Mr Davidson alleged that Mr Callaway rode carelessly in Race 8, in that he permitted his mount to shift outwards when not fully clear of ACCIDENTAL TOURIST (Mr Jacobson), which was crowded and checked near the 550 metres.

Mr Munro demonstrated on the rear-on video that near the 550 metres, Mr Callaway shifted outwards when not his length and another clear, which resulted in ACCIDENTAL TOURIST being crowded and checked. He said that while Mr Callaway had checked his mount, it was a stride too late.

Mr Callaway said INDUSTRIALIST was travelling well and he was unaware that Mr Jacobson was there. He said Mr Jacobson had yelled and he had corrected INDUSTRIALIST. He thought ACCIDENTAL TOURIST had been a bit late to respond, but he accepted he had made an error and it was fortunate that Mr Jacobson had got out of it ok.

Decision 

As Mr Callaway has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which showed 2 breaches of this Rule in the past 12 months. One was almost a year ago and the other was at Wingatui in late March. Mr Davidson said Mr Callaway has had 139 rides in the past 12 months and was stepping back from riding to further his training career.

Mr Davidson described the breach as low to mid-range.

Mr Callaway stated he accepted Mr Davidson’s submissions and wished the suspension to start immediately.

Reasons for Penalty

Mr Callaway has shifted ground outwards at the 550 metres when not clear and has crowded and checked Mr Jacobson. It is a low to mid-range breach. From a 6-day starting point, there is a one-day reduction for admission of the breach and Mr Callaway’s record, which considering the fact he is a busy South Island Rider, can be considered favourably.

Conclusion

Mr Callaway is suspended from the end of racing today, up to and including 21 December 2025. This is 5 national riding days.
