EVIDENCE:

Following the running of Race 2, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(1)(d) by Class A Jockey Mr Lee Callaway.

Mr Callaway stated he was conversant with the Rule, the Charge, and confirmed he admitted the breach.

Mr Davidson played the relevant video and had Stipendiary Stewards Mrs Rebecca Haley identify Mr Callaway (MANALI) drawn one from the outside of the starting gates. Mrs Haley pointed to Mr Callaway racing outside of WINTER BLAZE (R Beeharry) at approximately the 900m. She said at this point, Mr Beeharry had GIUSSEPE FERRANTE (T Comignaghi) racing to his inside. Mrs Haley showed Mr Callaway shift down the track, dictating Mr Beeharry onto Miss Comignaghi, who had to check out of her position.

Mr Callaway said his horse was a first starter and had stepped in for a stride on the bend. He said it had been a slight misjudgement on his behalf.

DECISION:

The Respondent having admitted the breach, the Charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Mr Callaway had three previous breaches under the Rule.

May –  4 days (low range)

July –  6 days (low range extended to include a South Island riding day)

August –  6 days (low-mid range)

Mr Davidson stated the Stewards’ view Mr Callaway’s record as neutral.

Mr Callaway made no submissions on Penalty, but asked to start any proposed suspension after 1 January 2025.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 5-day suspension for a low range breach, which this is.

Mr Callaway has not breached this Rule for more than 4 months and therefore, no grounds for uplifting the starting point.

Accordingly, the Adjudicative Committee considers the appropriate Penalty is a 5-day suspension.

CONCLUSION:

Jockey Lee Callaway’s Licence to ride in races is suspended from the conclusion of racing on 1 January 2025, up to and including racing on 7 January 2025.
