Penalty: Jockey Lee Callaway is suspended for 4 days

Mr Davidson alleged that in Race 8, Mr Callaway (LOVELOCK) rode carelessly in that he shifted ground inwards shortly after the start, contacting LOFTYS GIFT, which was forced inwards on to ASTRADEEL, which in turn was forced inwards into the line of THE TUI TOILER, which was checked.

Miss Haley demonstrated on the videos that Mr Callaway, who jumped from an outside stall, shifted inwards and in so doing, contacted LOFTYS GIFT, which was forced inwards on to ASTRADEEL which, in turn, was forced inwards into the line of THE TUI TOILER, which was checked, with the trailing VAGUE also having to steady. She said Mr Callaway was riding forward and had pulled his horse off the inside runners too late.

Mr Callaway said he was hunting his horse forward. He knew he had the whole length of the straight to cross. He was pushing his horse out, gave it a tap on the shoulder, and it stepped in on him. He would have been happy to sit outside the leader and did not intend to come across so quickly. He had not realised he had.

Decision

As Mr Callaway has admitted the breach, it is found to be proved.

Submissions as to Penalty

Mr Davidson produced the Respondent’s record, which showed 1 breach of this Rule in the past 12 months, in October last. Mr Callaway has had 255 rides this past year. Mr Davidson described Mr Callaway as a Senior South Island Rider, and the breach as low range.

Mr Callaway accepted Mr Davidson’s description of the breach.

Reasons for Penalty

Mr Callaway has shifted ground inwards shortly after the start, when not his length and another clear of the horses to his inside, which were forced inwards.

It is a low range breach and from a 5-day starting point, there is a one-day reduction for admission of the breach and Mr Callaway’s good record.

Conclusion

Mr Callaway’s Licence to ride in races is suspended from the end of racing today, up to and including 19 May 2024. This is 4 national riding days.
