Penalty: Jockey Daniel Bothamley is suspended 4 days

Mr Davidson alleged a breach of r 346(3) in that Mr Bothamley failed to make the correct weight for the horse STOP YELLING in Race 3.

Mr Davidson stated that Mr Bothamley had approached the Stewards at the start of the meeting and said that despite his efforts, he was unable to make the weight for his mount STOP YELLING in Race 3. He said Mr Bothamley had one previous breach of this Rule in the past 4 months. A Senior Jockey had been available to replace Mr Bothamley.

Mr Bothamley said he was struggling with his weight and preferred a suspension to a fine if this was possible.

Decision:

As Mr Bothamley has admitted the breach, it is found to be proved.

Submissions for Penalty:

Mr Davidson stated that the usual penalty for a second breach in the past 4 months was a $200 fine, however the Stewards had no objection to a suspension being imposed.

Mr Bothamley asked that the suspension commence after the meeting at Ashburton on 4 April.

Reasons for Penalty:

Mr Bothamley has ongoing weight issues. A suspension is appropriate on this occasion to give him a little time away from racing. A deferral is granted for the suspension to begin following the Ashburton Meeting on 4 April.

Conclusion:

Mr Bothamley is suspended from the end of racing on 4 April, up to and including 10 April 2024. This is 4 National Days.
