EVIDENCE:

Following the running of Race 3, Stipendiary Steward Mr Mark Davidson presented an Information alleging a breach of Rule 638(1)(d) by Class A Jockey Mr Daniel Bothamley.

Mr Bothamley stated he was conversant with the Rule and Charge, and he confirmed he admitted the breach.

Mr Davidson had Chief Stipendiary Steward Mr John Oatham identify Mr Bothamley (FINGERPRINTED) on the back straight video to show him racing 3- wide approaching the 1200m. Mr Davidson said Mr Bothamley has shifted inwards when only a bare length clear of LITIGATOR (D Tait) who was checked.

Mr Davidson said LITIGATOR perhaps overreacted but lost several lengths in the incident.

Mr Bothamley had nothing to add to the Stewards’ assessment.

DECISION:

The Respondent having admitted the breach, the charge was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Mr Bothamley has a clear record under the Rule. He said the breach is in the mid to high range, but Mr Bothamley deserves some credit for his record and admittance.

Mr Bothamley made no submissions on Penalty but asked for a deferment of any suspension until after 22 November 2023.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 7-day suspension starting point for a mid-range breach of this Rule.

The Adjudicative Committee agrees with the Stewards’ assessment of this breach as mid to high range and has adopted an 8-day starting point.

Mr Bothamley’s good record and admittance is worthy of a discount which the Adjudicative Committee sets at one day.

Deferment is granted and accordingly, Mr Bothamley is suspended for 7 days.

CONCLUSION:

Jockey Mr Daniel Bothamley is suspended from riding in races from the conclusion of racing on 22 November 2023, up to and including racing on 3 December 2023.
