Penalty: Jockey Daniel Bothamley was fined the sum of $250

Evidence:

At the conclusion of Race 9, Stipendiary Steward Mr M Davidson filed an Information under Rule 638(3)(g)(i) alleging Jockey Mr D Bothamley struck his mount RED SUNDAY seven times by the 100m mark.

Mr Bothamley admitted the breach and confirmed he understood the Rule and was present throughout the hearing.

The Rule reads a RIder must not strike a horse with a whip more than 5 times prior to the 100m.

Submissions:

Stipendiary Steward Mr Munro showed a video clip of the final 400m of Race 9 which highlighted RED SUNDAY mounting a run, and Mr Bothamley striking his mount seven times from the 400m mark to the 100m mark.

Mr Bothamley agreed with Mr Munro’s number of strikes.

Decision:

Mr Bothamley has admitted the breach which is proved accordingly.

Submissions For Penalty:

Mr Davidson stated that Mr Bothamley has an excellent record under this Rule with no previous charges. Mr Davidson stated that the NZTR Revised Penalty Guidelines 1st March 2022 for a first offence and two additional strikes being a fine of $500.

Mr Bothamley had no submissions on penalty.

Reason For Penalty:

The video evidence is very compelling, highlighting the seven strikes Mr Bothamley has struck his mount RED SUNDAY prior to the 100m. The NZTR Revised Penalty Guide is clear regarding the starting point for a fine and the Adjudicative Committee sees no reason to deviate from this whilst also taking into account Mr Bothamley’s outstanding record when fixing penalty.

Conclusion:

Mr Bothamley is fined the sum of $250.
