EVIDENCE:

Following the running of Race 1, the STALLION TENDER NOW OPEN MAIDEN, Stipendiary Steward Mr Mark Davison presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider Miss Tanya Jonker.

Miss Jonker stated she was familiar with the Rule and confirmed her admission of the breach.

Mr Davidson played the final straight video and identified Miss Jonker riding PINX, widest on the track upon straightening and counted 9 strikes before the 100m. He said there was just 2 in the final 100m.

Miss Jonker made no submissions.

DECISION:

The Respondent having admitted the breach, it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said Miss Jonker was fined on Saturday under the same Rule and a suspension in this case would be the appropriate Penalty.

Miss Jonker asked for any suspension to begin after racing on Saturday 10 August.

REASONS FOR PENALTY:

The Penalty Guidelines provide a 5+ day suspension for a second breach involving 3 additional strikes. The Adjudicative Committee has adopted a 6-day suspension starting point and cannot see any factors to deviate from the Guidelines on this occasion and considers a 6-day suspension as appropriate in this case.

The race meeting at Rotorua, 18 August, is not included in this suspension as it is a Jumps only day.

Miss Jonker’s request for deferment is granted.

CONCLUSION:

Jockey Miss Tanya Jonker’s Licence to ride in races is suspended from the conclusion of racing on 10 August, up to and including racing on 23 August 2024.
