EVIDENCE:
Following the running of Race 6, Mr Davidson presented an Information alleging a breach of Rule 638(3)(g)(i) by Class A Rider, Ms Tanya Jonker.
Ms Jonker stated she understood the Rule, the Charge and confirmed she admitted the breach.
Mr Davidson played the final straight video to identify Ms Jonker challenging the lead entering the home straight and counted 9 strikes before the 100m.
Ms Jonker agreed with the count and said it was a misjudgment.
DECISION:
The Respondent having admitted the breach it was deemed to be proved.
SUBMISSIONS FOR PENALTY:
Mr Davidson said Ms Jonker has a clear record under the Rule. Mr Davidson said as per the Guidelines a suspension is in order.
Mr Jonker made no submissions for Penalty but said she had confirmed rides at Gore on Wednesday 25 October.
REASONS FOR PENALTY:
The Penalty Guide provides for a first breach a 5-day suspension for 4 or more additional strikes. The Adjudicative Committee with consideration of Ms Jonker’s good record conclude a 4-day suspension is appropriate in the circumstances of this case.
CONCLUSION:
Deferment is granted and Jockey, Tanya Jonker is suspended from the conclusion of racing on 25 October 2023 up to and including racing on the 1 November 2023.
