BACKGROUND:

Following the running of Race 2, Cup Week Hospitality On Sale 25 June Rating 65, Class A Jockey, Kylie Williams, admitted a breach in that, as the Rider of THEE AULD MINX in the race, she rode carelessly in permitting her mount to shift outwards when not sufficiently clear, crowding MOVIE GIRL (Abdul Najib) near the 200 metres.

Rule 638 provides as follows:

(1)    A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be:

        (d)   careless.    

EVIDENCE:

Stipendiary Steward, Mark Davidson, had Chief Stipendiary Steward, John Oatham, demonstrate the incident on video replays. He pointed out that, at about the 300 metres, the Respondent was held up by another runner. She then got to the outside of that horse. MOVIE GIRL, ridden by Mr Najib was to her outside. The Respondent shifted out an extra horse-width, which dictated Mr Najib onto the hind quarters of RADIANT ROSIE, resulting in him being held up for a few strides.

The Respondent did not wish to comment.

DECISION:

The breach having been admitted, it is deemed proved.

SUBMISSIONS FOR PENALTY:

Mr Davidson said that Stewards saw the breach as being at the low end. The Respondent has a very good record, with two recent suspensions from 506 rides in the last 12 months:

2 March 2024 at Otago – suspended 4 days, low-range.

28 April 2024 at Otago – suspended 4 days, low-range.

Some inexperience on the part of Mr Najib may have contributed to the incident, Mr Davidson said.

The Respondent sought a deferment of suspension until after the meeting of Canterbury Racing on 27 June 2024.

REASONS FOR PENALTY:

The Adjudicative Committee is satisfied that the breach is low-level. The Respondent’s shift was slight and Mr Najib’s inexperience did not assist.

The Respondent’s record is a very good one, notwithstanding the two recent breaches, both of which were also low-level. She is a very busy and experienced Rider.

The RIB Thoroughbred Racing Penalty Guide (February 2023) suggests a starting point for a low-level careless riding breach of a 5-days suspension. There are no aggravating factors. By way of mitigating factors, the Adjudicative Committee has had regard to the Respondent’s admission of the breach and her good riding record. A 1-day discount from the Penalty Guide starting point is given for those factors

CONCLUSION:

The Respondent’s application for a deferment is granted.

She is suspended under her Class A Licence from riding in races for a period commencing on 28 June 2024, up to and including 3 July 2024 – 4 national riding days.
