Penalty: Cameron is fined the sum of $200

BACKGROUND:

Following the running of Race 10, Open Driver, Ross Cameron, admitted a breach of Rule 869(4)(6)(b)(c) in that, “as the Driver of AUDACITY in the race, he shifted outwards near the 1400m forcing RADHA wider on the track.”

Rule 869 provides as follows:

(4) No driver shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.

(6) Subject to sub-rule (4) hereof:-

(b) a horse during any race shall not be forced to race wider on the track;

(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.

EVIDENCE:

Stipendiary Steward Matt Sole, with the assistance of  Stipendiary Steward Shane Renault, showed available video replays of the incident, which occurred with approximately 1400 metres to run. He pointed out AUDACITY, driven by the Respondent, racing mid field and 2 wide whilst in the trail of HERE’S HERBIE, driven by Colin DeFilippi, with RADHA, driven by Blair Orange, racing to the outside of AUDACITY, approaching the 1400.  Mr Renault demonstrated on the replays that HERE’S HERBIE shifted out into a 3 wide position near the 1400m, with Mr Cameron following him out and as a result, Mr Orange, who was racing on Mr Cameron’s quarter to the outside, was forced out wider on the track.

Mr Cameron stated that he followed Mr DeFilippi out into the 3 wide line and conceded that he had forced Mr Orange wider on the track.

DECISION:

As Mr Cameron has admitted the breach, the charge is found proved.

SUBMISSIONS FOR PENALTY:

Mr Sole said that the Respondent has had 57 drives in the current season, with 63 last season and his record under the Rule is clear. He submitted that there were no aggravating or mitigating factors to consider and the breach could be dealt with by way of a $200 fine, as per the Penalty Guide.

REASONS FOR PENALTY:

The RIB Harness Racing Penalty Guide provides a starting point for an initial breach of this Rule of a fine of $200. The Adjudicative Committee determined that there were no aggravating or mitigating factors to consider, therefore deemed that a fine of $200, commensurate with the Penalty Guide, would be imposed.

CONCLUSION:

The Respondent, Open Driver Ross Cameron, is fined the sum of $200.
