Penalty: Apprentice Jockey Ashvin Goindasamy is fined $500

EVIDENCE:

Following Race 4 Information A15607 was filed with the Adjudicator.  It was alleged by the Informant that Mr Goindasamy struck his mount “POZZI VIBE” 6 times with the whip prior to the 100m.

Mr Goindasamy in the presence of Mr Harris said that he understood the Rule, the Charge and confirmed that he admitted the breach.

Mr Oatham showed the film replays and pointed out that Mr Goindasamy struck his mount once with the whip in the right hand, then changed the whip to his left hand and struck his mount a further 5 times prior to the 100m.

Mr Goindasamy agreed with the Stewards’ interpretation.

REASON FOR DECISION:

As the charge was admitted, it was found proved.

SUBMISSION FOR PENALTY:

Mr Oatham said that Mr Goindasamy had one prior breach of the Rule when a fine of $300 was imposed.

Mr Harris said that Mr Goindasamy is trying too hard and as a consequence his mounts tend to shift about.

REASON FOR PENALTY:

The Penalty Guide provides that a fine of $500 is the starting point for a second breach of the Rule.  $500 was considered to be a suitable penalty.

CONCLUSIONS:

Mr Goindasamy was fined $500.
