Evidence:

Following the running of Race 10, the Respondent, Class A Rider, Ms B Grylls admitted a charge of careless riding which was filed pursuant to Rule 638(1)(d).

The Information alleged that as the Rider of MR NICE she “permitted her mount to shift out when insufficiently clear of CHARLIE CHUCKLE (J Doyle) which had to be checked near the 250 metre mark.”

Ms Grylls acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Adjudicative Committee considers to be careless.

Using the available Race films Stipendiary Steward, Mr Dooley demonstrated the incident and identified the horses and Riders concerned.

Mr Dooley said that near the 250 metre mark, Ms Grylls has shifted ground when insufficiently clear of CHARLIE CHUCKLE who as a result had to be checked.

In response, Ms Grylls stated her horse had shifted out with the whip and she had not been able to straighten it before checking the horse, CHARLIE CHUCKLE.

Decision:

As Ms Grylls admitted the breach the Adjudicative Committee finds the breach proved

Submission for Penalty:

Mr Dooley produced Ms Grylls’ riding record. She had had 186 rides this season and three previous breaches under the Careless Riding Rule in the last 12 months. The latest was a 6 race day suspension at Hastings on Saturday 14 October. for a low to mid- range infraction.  She had taken a deferment of that penalty which applied from 22 October to 1 November (inclusive).

Mr Dooley said Stewards assessed the level of carelessness to be in the low to mid range.  To the Rider’s credit she had admitted the breach and her record had been good until Hastings last Saturday.

In terms of any proposed penalty, Ms Grylls made no comment.

Reasons for Penalty:

After considering all submissions the Adjudicative Committee determined that Ms Grylls’ carelessness to be more low than mid range and a 5 day suspension was therefore imposed.

Conclusion – Penalty:

The Respondent’s Licence to ride in races is suspended for a period of 5 days commencing after racing on Wednesday 1 November and concluding after racing on Wednesday 8 November 2023.
